Why lenders foreclose instead of short saleAs a Massachusetts Realtor who deals with short sale transactions on a daily basis, I have seen and learned quite a bit since I started getting involved with these types of transactions four years ago.

One thing that I am extremely proud of is the fact that every short sale that I have listed has received short sale approval from the lender. This is no small feat, as nationally the success rate for completing a successful short sale in less than 30%.

I certainly can not take all the credit as the attorney I work with does all of the grunt work with the lender. The short sale law firm I use does outstanding work. My job in a short sale is the same as with any home I am marketing….get it SOLD! This means finding a buyer who will pay something in the ball park of market value and be willing to wait the time it takes to get short sale approval which is typically longer than a regular transaction.

Of course part of getting a short sale to the closing table is knowing how to follow proper procedures. The are plenty of Realtors getting involved with short sales who are completely clueless but see it as a money making opportunity and are willing to put a seller’s financial future at risk for their own potential gain.

Here are a few mistakes that I see repeated over and over again by Real Estate agents that don’t know any better:

  • Realtors® submitting multiple unsigned offers to the lender.
  • Realtors® submitting low ball offers to the lender.
  • Realtors® allowing home inspection contingencies after short sale approval.
  • Realtors® allowing an investor to negotiate the short sale.

If you are a Realtor and work with short sales you may want to check out the article I wrote about one type of short sale fraud. The blog article is a very transparent battle between my view points, views of a few other Realtors and those of short sale investors.

If you are into controversy go visit the article because you are in for a real treat! In fact the article was plagiarized on Active Rain and I had to ask the powers that be take it down!

Many of the short sale investors who made comments have a problem with the title of the article as they believe that I am casting a negative light on all short sale investors. Actually this was not my intention in writing the article at all.

I truly want to make all consumers aware of what is going on in the world of short sales. There is short sale fraud taking place on a monthly basis throughout the country.

Don't tell an investor that though....they won't believe you. In fact they believe the national media has it all wrong.

Short sale fraud comes in many forms but the example I discussed was when a short sale that is listed for $175,000 receives an offer from a couple that wants to buy the home for $160,000.

Instead of submitting the offer to the lender, the agent calls up an investor friend and has them submit an offer for $140,000. The agent does not let the lender or seller know about the $160,000 offer but instead submits the investors offer of $140,000.

The investors offer of $140,000 gets accepted and the investor turns around and sells the property to the couple who was willing to pay $160,000. Folks this is what is known as MORTGAGE FRAUD! The other term for this practice is known as “flopping”. Someone caught doing this will more than likely find themselves in Federal Court. Both the Realtor and investor in this example are obviously criminals.

The article goes on to talk about why a consumer should do their home work when deciding to work with an investor or not.

There were some very good points made from some of the investors along with some ridiculous statements from others that don't have a clue about Real Estate laws and what the term fiduciary responsibility means. The ones that really get me are the investors who are also Realtors. Frankly they should know better.

They were all trying to poke holes in everything I wrote and were even bashing me in their investor forums (Bigger Pockets) all the while thinking I would not see it. Most of them obviously don't know how the internet and search engines operate. It was very comical to watch it all unfold behind the scenes.

All these investors were writing things like "I am the dumbest Realtor in the Northeast", "I can't believe this guy can even get business he's so stupid and that's putting it nicely", "I can't even believe he got a license". While I certainly have strong opinions, I did not post any disparaging remarks. I truly was LMAO looking at some of the comments being written.

I have been fortunate that I have closed every short sale I have listed. I will admit there is some luck involved with that and my streak will come to an end at some point. A couple of investors did not believe me and went so far as to call me a liar. Real Classy. And investors wonder why they get a bad rap with Realtors!

What you can take away from this article and the comments from investor land is that they absolutely hate it when Realtors mention anything negative about them. We all know there are good and bad eggs in every business. There is no exception for those in the investment world. Don't tell them that though. Every one of them is walking on water in their eyes. The media is just providing sensational journalism folks!

They will tell you that they are providing a service and helping home owners escape foreclosure. Fine..I have no problem with that. In fact I believe that all of the investors that visited my blog and made comments are probably honorable, trustworthy and good at what they do.

I repeatedly stated over and over that I don't have a problem with their business. If they can free a short seller from their debt and make a profit all the power to them.

There is a very big difference however, when a property is listed with a REALTOR and here is why!

Realtors should not let short sale investors take over negotiations with a lender!

The reason why short sale Realtors should not let a short sale investor take over negotions with a lender is fairly obvious.

If you are a Realtor who does short sales or is thinking about doing them here is where you really need to pay attention. Without a doubt we live in a very litigious society today. There is going to be lawsuits that come out of many of the short sale transactions that are taking place or should I say don't take place.

When you sign a listing contract to represent a seller they are YOUR client. YOU are THEIR trusted adviser and advocate. You need to be thinking about doing everything possible that benefits THEM.

The same holds true when it is a short sale transaction. The rules of the game don't change! This is where investors don't understand that we are held to different legal standards than they are.

What do you mean by that Bill? Simple...when a person needs to short sell their home and they hire me they can expect that I am going to do everything that I normally do for every other seller. My goal is to get my client the best terms and conditions.

Once I get a good offer from a buyer that has a strong probability of closing, an attorney, who is part of my team, takes over the negotiations with the lender. The attorney I use is very good at what he does. This is part of the reason why the seller hired me. Most of the sellers have done their research and selected me because of my track record with closing short sales.

When an investor approaches you about making an offer they will undoubtedly want to negotiate the deal for the seller. Well guess what the seller didn't hire an investor to get them out of the financial mess they are in... they hired YOU!

If you go along with this arrangement and the transaction goes sour for any reason causing the seller to be foreclosed on guess where the fingers are going to be pointed. Do you have a mirror handy? This is akin to letting a buyer's agent negotiate for the seller!

I can already hear the seller's attorney in court:

"The Realtor said this was a good idea and told you should let the investor take over the short sale negotiations Mrs. Jones. Is this correct? Yes sir it is.

"Didn't you hire this Realtor and his team to help you with your short sale mam"? Yes I did sir.

"Did the Realtor advise you to work with this investor mam"? Yes sir they did.

"Do you know this short sale investor MR. Gassett?" No sir I do not.

"Mr. Gassett do you think the investor was working on behalf of the interests of your client"

Well Um Err they told me they were going to do everything in the best interests of Mrs. Jones.

Your honor.... no further questions.

NO THANKS! I certainly don't want to find myself in court and neither should you. Do yourself a favor and don't end up looking like the dude above.

In August of 2010 there were 12 homes that closed within the month for Westboro Massachusetts. This is an decrease of 2 units, as there were 14 homes that closed in August of 2009.

The Average list price for the homes that closed in Westboro for August of 2009 was $547,786

The Average list price for the homes that closed in Westboro for August of 2010 was $493,492

The Average sale price for the homes that closed in Westboro for August of 2009 was $530,100

The Average sale price for the homes that closed in Westboro for August of 2010 was $475,000

The Average Market time for the homes that closed in Westboro in August of 2009 was 103 days.

The Average Market time for the homes that closed in Westboro August of 2010 was 85 days.

 

3 homes went under agreement in Westboro Massachusetts in the month of August. The average list price of the homes that went under agreement was $395,600. The average time on the market for these Westboro MA homes were 343 days.

Through August there have been 77 homes sold in Westboro. At this same time last year there were 84 closed sales.

 

             January - December 2008 & 2009 Market Statistics for Westboro Massachusetts

In Westboro MA for the period of January to December of 2008 there were 130 properties sold.

In Westboro MA for the period of January to December 2009 there were 133 properties sold.

In Westboro MA for the period of January to December in 2008 the average list price was $464,290 the average sale price was $444,367, and the average market time was 97 days.

In Westboro MA for the period of January to December in 2009 the average list price was $465,326 the average sale price was $443,595 and the average time on the market was 125 days.

** The above statistics are for single family homes only and do not include condo's or Multi-family homes in Westboro Massachusetts.

In comparing year over year longer term data for Westboro Massachusetts, the average list price and sale price were very similar to 2008. Westboro ended the year with 3 more sales than in 2008 so the number of transactions remained constant. What was most surprising is the fact that the average time on the market jumped by quite a bit to going from 97 days on the market in 2008 to 125 in 2009.

As we start 2010 inventory levels in Westboro are very low which is a great sign for the Spring market. There is some evidence to suggest that we may be nearing the Real Estate bottom for Westboro and the surrounding area.

Hopkinton Massachusetts Named to Money Magazine Best Places to Live 2009

Hopkinton Massachusetts Makes Money Magazine Best Places to live 2009Hopkinton Massachusetts has just been named to the Money Magazines prestigious list of the best places to live in the US for 2009! Not only did Hopkinton make the list but they broke the top 20 coming in at #19.

The awards just continue to roll in for Hopkinton, as this latest award is fresh on the heels of Hopkinton High School making Newsweek Magazine top 500 Schools for 2009.

This is the 2nd consecutive year that Hopkinton has made Newsweek's list for bragging rights as one of the best school systems in the country. This year Hopkinton high school came in ranked 420 out of the top 1500 schools! Hopkinton also made Boston Magazines 50 best high schools in 2008.

Getting recognized by Money magazine is nothing to sneeze at as it is one of the most widely read financial publications. As a Realtor who has lived in Hopkinton my entire life and has sold Real Estate in the town for the last twenty three years, this will do nothing but enhance an already strong reputation.

Hopkinton is a destination town for many home buyers because of the terrific commuting location, awesome school system, and some of the best developments in the area.

Hopkinton is located at the "cross roads of New England" with 495 and the Mass Pike at our door step. The MBTA is also located just over the Hopkinton town line in Southboro.

Other considerations that make Hopkinton a great place to live include a town center that is not over commercialized. It is doubtful you will see a McDonalds in Hopkinton anytime soon:) There are also two large lakes known as Lake Maspenock and Lake Whitehall, as well as the popular Hopkinton State park for recreation.

I could go on and on about the many great attributes of the town...these are just a few. Although I would be remiss if I did not mention the fact that the Boston Marathon starts in Hopkinton.

Hopkinton Massachusetts Special Olympics

     There will be a benefit held on February 16, 2008 for the Hopkinton Special Olympics. One of my friends, Alec Levine of Hopkinton will be participating for the third time in the annual Massachusetts Special Olympics Passion Plunge by jumping into the Atlantic Ocean at Revere Beach, rain, snow, sleet or shine.

Alec takes the Passion Plunge for the benefit of Hopkinton's Special Olympic athletes. The Hopkinton Special Olympics program began four years ago. Initially, basketball was the only sport in which special athletes could participate. In only four years the program has grown not only in the number of athletes, but also the number of sports offered. Hopkinton's Special Olympians are now participating in basketball, softball, soccer, and bowling.

In order for the these programs to continue successfully donations are needed. Donations can be large or small - every little bit helps. If you are interested in offering support you donate at First Giving which is Alec Levines website.

  TheFishGuyis a full service aquatic company located in Framingham Massachusetts. They design, build, maintain, and service any size pond or aquarium. They will do as much or as little as the customer wants. Some of their customers like to get their own fish and do some of the maintenance themselves, but call them in to do periodic service to check on their progress. Below is a sample of a home that was purchased that had a neglected pond in the back yard. There were about 100 fish living in the pond. The pond had been in this state for around twelve years.  TheFishGuys came in and restored in to a beautiful fish pond that anyone would enjoy! The "after" shot shows the difference between cleaning out the pond, pruning the surrounding plants, weeding around the pond, and the addition of a small waterfall and pond lighting.

It's Good To Have Friends in High Places!

 

I recently had the opportunity to take in a Boston Red Sox game up on the famous Green Monster at Fenway Park.

I was treated to these great seats by former Red Sox pitcher Jim Corsi who happens to be one of my best friends and past client as well. I have done five real estate transaction with Jim over the last six years.

Jim is a Newton MA native and played in the major leagues for ten years. Jim played professional baseball for nineteen years including the minor leagues. Jim played for the Boston Red Sox, Oakland A'S, Florida Marlins, and a short stint with the Baltimore Orioles to end his career.

One of Jim's best years happened to be while playing for my beloved Red Sox in 1998. He also had productive years with the Oakland A'S. He pitched in the post season for both the Red Sox and Oakland A's.

Aside from the fact that I got to sit in these great monster seats, I had the opportunity to meet some most interesting "characters". I was able to meet Hall of Famer Dennis Eckersley, Red Sox legend Luis Tiant a.k.a El Tiant, The "Spaceman" Bill Lee, Red Sox announcer and former player Jerry Remy and veteran Boston TV sportscaster Bob Lobel.

Now that I think of it I also got re-introduced to Former Boston College and NFL Star Doug Flutie of Natick MA. I had met Doug years earlier while playing some pick up basketball in Natick MA.

It was an unbelievable night getting to meet all these guys. It is a night I will never forget.

If you are a baseball fan, watching a game at Fenway Park in Boston is like nothing else. This is an attraction you surely would not want to miss if you are visiting Boston.

The Boston Marathon & Hopkinton MA....It all starts Here!

Hopkinton Massachusetts is a terrific place to live. I should know I have lived here for the last forty two years. I have also been selling Real Estate in Hopkinton for the last twenty three years. What originally put Hopkinton on the map, so to speak is the fact that the Boston Marathon starts here in little ole Hopkinton MA.

 Hopkinton to Boston Marathon

 The Boston Marathon is one of the most recognizable events. It has grown so large it is by and large the most covered marathon in the world. Last year there were over 20,000 runners! This day is very exciting here in Hopkinton MA. It is truly an experience with a circus like atmosphere. Hopkinton, however, is more than just the starting point for the Boston Marathon. Hopkinton MA is a great place to raise a family. Hopkinton is located about 26 miles West of Boston which makes it an ideal location for people commuting to work everyday. Access to highways is great as the "Cross roads of New England", Route 495 and the MA Pike are right here.

 

Hopkinton has experienced tremendous growth over the last decade. Real Estate values in the town of Hopkinton have sky rocketed. It has become a "destination" town for people looking to settle down into a nice home.

 There are many factors that contribute to Hopkinton being a great place to live besides the excellent commuting location. The schools in Hopkinton are very highly regarded. A new state of the art high school was just built a few years ago.

Hopkinton High SchoolThe athletic center know as the "Field House" in the new high school is close to what you would find at a small college. It is really impressive!

Hopkinton has many great neighborhoods. In fact, in relation to other neighboring towns there is much more variety and number of "subdivision" type neighborhoods. There is a variety of Real Estate choices in Hopkinton MA. Homes for sale in Hopkinton are priced from the mid 200's for a small starter home which most likely needs work to beautiful Multi Million dollar homes.  Seen below is a sampling of some homes currently for sale in Hopkinton MA.

  

Some of the top high end subdivisions in Hopkinton include Highpark, Springwood Estates, Forestside Estates, Ravenwood, The Highlands, and Circa 1700 Country Village. Homes is these Hopkinton neighborhoods start in the 600's and go up to a million plus.

The town does not have a big commercial base. Hopkinton has a very rural feel to it. You will not find establishments such as McDonald's and Burger King in Hopkinton. The residents of Hopkinton have wanted it this way, in keeping with the master plan. The town center has a very quaint feel to it. Large scale shopping for groceries and clothing is done in the neighboring towns of Milford and Westboro. There is a large scale mall located about 20 minutes away in Natick MA. There is a small super market in town center called Collela's Market for things needed in a pinch. For a better understanding of the demographics in Hopkinton MA Citi-data is an excellent resource.

One of the most visible companies that employs a number of people living in Hopkinton as well as other surrounding Metrowest towns is EMC Corporation. Emc is a computer data storage company with its main offices located on South Street in Hopkinton.

Hopkinton is going to under go some substantial future growth as one of the largest Nurseries in the united States known as Weston Nurseries, has sold off a large chunk of their land for future development. There will be an additional 940 units built at the Weston Nurseries site. You can read about the future development of Weston Nurseries here. It will be a mix of residential homes, condos, affordable housing, as well as commercial and retail space. The subdivision and the homes there will be be part of what's called Legacy Farms.
