      <title>Massachusetts Oil Heating Upgrading and Insurance Law</title>

The new legislation is designed to prevent leaks from pipes and equipment that connect to your furnace.&lt;/p&gt;
&lt;p&gt;The new law is addressed in &lt;a href=&quot;http://www.mass.gov/legis/laws/seslaw08/sl080453.htm&quot; target=&quot;_blank&quot;&gt;Chapter 458 of the Acts of 2008&lt;/a&gt;. The two biggest provisions of the law change include the following:&lt;/p&gt;
&lt;ul&gt;
&lt;li&gt;The installation of either an oil safety valve or an oil supply line with a protective sleeve on systems that do not already have these devices in place.&lt;/li&gt;
&lt;/ul&gt;
&lt;ul&gt;
&lt;li&gt;Insurance companies that provide home owners insurance policies must offer coverage for oil tank leaks from heating systems that use oil.&lt;/li&gt;
&lt;/ul&gt;
&lt;p&gt;&lt;strong&gt;&lt;span style=&quot;color: #cc0000;&quot;&gt;What is important to note is that most home owners policies do not currently include coverage for oil leaks leaving home owners to fend for themselves with costly clean up bills. The new law makes it mandatory for insurance companies to offer coverage, however it is up to the individual home owner to purchase this optional insurance. Implementation of the insurance coverage will also start as of July 1, 2010.&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;&lt;span style=&quot;color: #000099;&quot;&gt;&lt;strong&gt;&lt;span style=&quot;font-size: 11pt;&quot;&gt; &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;&lt;big&gt;&lt;span style=&quot;color: #000099;&quot;&gt;&lt;strong&gt;&lt;big&gt;Who must take action?&lt;/big&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/big&gt;&lt;/p&gt;
&lt;p&gt;Homeowners of one to four unit dwellings that are heated with oil must already have or install an oil safety value or an oil supply line with a protective sleeve. Installation of these parts must be completed by a licensed oil burner technician.&lt;/p&gt;
&lt;p&gt;If your home was built prior to January 1 1990, you are more than likely already in compliance with the new law because state fire codes were changed to require these parts on new installations at that time.&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;&lt;span style=&quot;color: #000099;&quot;&gt;&lt;big&gt;&lt;big&gt;&lt;strong&gt;Who is exempt?&lt;/strong&gt;&lt;/big&gt;&lt;/big&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;Homeowners are not required to comply with these leak prevention steps if the oil burner is&lt;/p&gt;
&lt;ul&gt;
&lt;li&gt;Located above the oil storage tank and the entire oil line is connected to and above the top of the tank.&lt;/li&gt;
&lt;li&gt;An oil safety valve or oil supply line with protective sleeve was installed on or after January 1, 1990 and&lt;/li&gt;
&lt;li&gt;The changes are in compliance with the oil burning equipment regulations. The copy of the oil burner permit from the local fire department may be used to demonstrate you are in compliance.&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;Complying with this new law is a no brainer! The cost of cleaning up an oil spill is very expensive. The cost of making this upgrade is very cheap. We are talking about a few hundred dollars to make these upgrades. Why take a chance and be left with a bill that could cripple you financially!&lt;/p&gt;
&lt;p&gt;If you are unfortunate enough to have a leak and it reaches the soil beneath your home then a clean up is going to be necessary to bring your property back into compliance with state environmental standards. If the leak is severe enough and it impacts your neighbors or the local ground water supply the bill is going to be astronomical.&lt;/p&gt;
&lt;p&gt;In Massachusetts, reports indicate that there are a few hundred spills a year. If you have a spill the cost for clean up on the low end is going to be $15000 to $20,000 dollars. A high end clean up can easily get into the hundreds of thousands! Who would ever want to deal with this kind of nightmare when it is so easy to avoid? I know if I owned a home that was built prior that 1990 I would not want to even think about such a catastrophe. I would make darn sure I was compliant right away!&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;

&lt;p&gt;The insurance will provide &quot;1st party coverage&quot; of at least $50,000 to cover the expenses of cleaning up a leak to soils, indoor air, or other environmental media from a home heating system at the residence itself and also reimbursement for personal property damage.&lt;/p&gt;
&lt;p&gt;Secondly you must provide for &quot;third party coverage&quot; of at least $200,000 for dealing with any problems that occurred as a direct result of the leak for damage off of the property. This could be a near by home or the local ground water. The insurance coverage will also include costs for legal fees subject to a deductible not to exceed $1000 per claim.&lt;/p&gt;
&lt;p&gt;*** The key point to remember with the Massachusetts Oil Heating and Insurance law is that an an upgrade is more than likely be necessay only if your home was built prior to 1990.&lt;/p&gt;

Rory mentioned there is some talk about asking home inspectors to police homeowners who are not compliant with the law at the time of a home inspection.&lt;/p&gt;
&lt;p&gt;From a home inspectors perspective, I am sure they will not be too thrilled to carry the burden of this task.&lt;/p&gt;

      <title>Massachusetts Property Tax Relief - Who Qualifies to save?</title>

After all we didn't get the name &quot;Taxachusetts&quot; for nothing.&lt;/p&gt;
&lt;p&gt;Lately, it seems everywhere you turn there is bad news. The local&amp;nbsp;Real Estate market has been down in the dumps, the stock market has taken a&amp;nbsp;fairly big&amp;nbsp;hit, the cost of oil and energy in general is out of sight, and there is talk of a recession.&lt;/p&gt;
&lt;p&gt;With the exception of&amp;nbsp;historically low mortgage interest rates, there have not been many reasons to get overly excited by the present shape of our economy.&lt;/p&gt;
&lt;p&gt;Taxes have been an issue for years in Massachusetts. Especially some of the towns located in Metrowest MA that have had extremely high property appreciation rates.&lt;/p&gt;
&lt;p&gt;Up until the last few years Real Estate in Metrowest Massachusetts was booming. Along with the increase in property values came higher tax bills. This has become a wide spread problem for the elderly and those on fixed incomes.&lt;/p&gt;
&lt;p&gt;In Massachusetts there are programs available to help those in need of tax relief.&lt;/p&gt;
&lt;p&gt;There are a few programs worth discussing including&amp;nbsp;&lt;strong&gt;clause 41c for elderly residents&lt;/strong&gt;, &lt;strong&gt;clause 17d which is an exemption for seniors, surviving spouses, and minors,&lt;/strong&gt;&amp;nbsp;&lt;strong&gt;clause 22 covering veterans&lt;/strong&gt;, &lt;strong&gt;clause 37a which covers the blind and two others know as the Circuit Breaker and&amp;nbsp;the standard tax deferral.&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;Below is an explanation of each one of these exemptions:&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;Clause 41C - &lt;/strong&gt;Clause 41c is for elderly residents. Residents who are 65 years old by July 1 may qualify for a $1000 dollar tax credit. The income requirements for this program if single&amp;nbsp;are $23,718 per year and assets not in excess of $40,000. If you are married the income requirement is less than $35,578 and assets not is excess of $55,000. The other requirement with 41c is that you have to be living in Massachusetts for the last ten years and owning/occupying property for the last five.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;Clause 17D - &lt;/strong&gt;Clause 17d is an exemption in the amount of $208.39. In order to qualify for 17d a senior must be 70 years old by July 1 and surviving spouses must be a widow or widower by July 1. For a minor to qualify for this program they must have a deceased parent and own the property. In all of these circumstances the total worth may not exceed $40,000 excluding assessed home value.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;Clause 22&lt;/strong&gt; - There are various exemptions for veterans and their spouses ranging from $400-$1000. In order to qualify you must have certification of a war related disability and also not have been dishonorably discharged.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;Clause 37A&lt;/strong&gt; - Clause 37a applies to those who are legally&amp;nbsp;blind as of July 1. The tax credit is $500. In order to qualify you must also be registered with The Massachusetts Commission for the blind.&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;Tax Deferral&lt;/strong&gt;- Residents 65 years or older can defer all or a portion of their taxes at a rate of 5% interest. In order to qualify residents must have lived in MASS for the past ten years&amp;nbsp;and owned/occupied their home for the last five years. Gross annual income must not exceed $40,000. This a a program that not many people are aware of. In my home town of Hopkinton MA the town places when the deferral is approved and payment is made upon the sale of the home.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;The Circuit Breaker&lt;/strong&gt; - This exemption is available to residents age 65 and over whose property taxes exceed 10% of their income. This figure includes&amp;nbsp;water and sewer bills.&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;These are great programs that are available in &lt;strong&gt;Hopkinton MA&lt;/strong&gt; and other &lt;strong&gt;Metrowest Massachusetts&lt;/strong&gt; communities. I suspect that if more people knew about these options they would take advantage of them.&amp;nbsp;Hopefully a few people will read this and I&amp;nbsp;will&amp;nbsp;end up&amp;nbsp;saving them a few dollars.&lt;/p&gt;
&lt;p&gt;It would be great if there were other programs such as these that more people in Metrowest Massachusetts could take advantage of. The cost of living here is high and there are others besides seniors who could use the help.&amp;nbsp;&lt;/p&gt;
